After the War of Independence of the United States, some 50,000 American colonists who remained loyal to Britain or who had rendered military service in the British regiments of Loyalists had left the new republic. Approximately 6000 of these loyalists were installed in areas south-west of Montreal on the banks of the St. Lawrence River and the Niagara River and the north shore of Lake Ontario. This population of English language and religion mainly Protestant, wished to see established a colony governed by British laws and institutions that were familiar to them [1]. Upper Canada received more immigrants from the United States long after the War of Independence. More dubious loyalty, these newcomers to New England or New York were attracted by good farmland. Upper Canada played an important role in the Anglo-American War of 1812, is subject to many attempts of invasion by the Americans. The city of York (now Toronto), the capital city, was plundered and destroyed in 1812 by the American army. However, the British, aided by militia of Upper Canada, the Americans arrested at the Battle of Queenston Heights. Most of the new American colonists remained neutral during the conflict, although some individuals actively helped the U.S. side. "The Law Society of Upper Canada publicly condemns the arrest and imprisonment of Judge Maria Lourdes Afiuni for the release of a defendant whose detention was in violation of Venezuelan law. The retaliation of the judges in exercising their judicial functions and guaranteed by the Constitution demonstrates a disregard for the fundamental functions of the principle of judicial independence and undermines democracy and the rule of law. Reports indicate that the December 9, 2009 the Judge Maria Lourdes Afiuni was arrested by intelligence officers (Venezuela) after ordering the conditional release pending trial, Eligio Cedeño. The detention of Mr. Cedeno was declared arbitrary in September 2009 by the Working Group on Arbitrary Detention of the United Nations, citing violations of their right to a fair trial. The actions of Judge Afiuni were consistent with the conclusion of the United Nations Working Group. Afiuni The judge released under precautionary measures Mr. Cedeño, because he had remained in custody for almost three years, a violation of a limit of two years provided by Venezuelan law. As a result, Afiuni judge was accused of corruption, and accessory to escape, criminal conspiracy and abuse of power. The Law Society of Upper Canada is deeply concerned about judges in Venezuela, in full exercise of their judicial functions, can be subjected to arrest and detention when their decisions are contrary to the views of public authorities. The release and security in all circumstances the physical and psychological integrity of Judge Maria Lourdes Afiuni; put an end to acts of harassment against Judge Afiuni and all judges in Venezuela, a public recognition of the importance and legitimacy of the work of judges and their contributions to strengthening democracy and the rule of law, ensure that all judges to carry out their peaceful and legitimate activities without fear of arrest and detention, and ensure in all circumstances respect for human rights and fundamental freedoms in accordance with national standards of human rights and international instruments ratified by Venezuela.
